Model Arbitration Clause

Parties wishing to refer disputes to arbitration administered by the Goverion Arbitration and Mediation Court are encouraged to include the following clause in their contracts:

Recommended Clause

Any dispute, controversy, or claim arising out of or in connection with this contract, including any question regarding its existence, validity, interpretation, performance, or termination, shall be referred to and finally resolved by arbitration administered by the Goverion Arbitration and Mediation Court in accordance with its Arbitration Rules in force at the time of the commencement of the arbitration.

The seat of arbitration shall be [City, Country].
The language of the arbitration shall be [Language].
The number of arbitrators shall be [one / three].

This clause allows parties to ensure that any disputes arising under the agreement are resolved through a neutral and structured arbitration process administered by the Court.

Model Mediation Clause

Parties seeking to resolve disputes through mediation may incorporate the following clause in their agreements:

Recommended Clause

In the event of any dispute, controversy, or claim arising out of or in connection with this contract, the parties shall first attempt to resolve the dispute through mediation administered by the Goverion Arbitration and Mediation Court in accordance with its Mediation Rules.

If the dispute has not been resolved through mediation within [30 / 45 / 60] days from the date of commencement of the mediation, the dispute may thereafter be referred to arbitration or other dispute resolution procedures as agreed between the parties.

This clause encourages parties to pursue an amicable resolution before initiating more formal dispute resolution proceedings.
