Mediation Rules
The mediation proceedings administered by the Goverion Arbitration and Mediation Court are conducted under the institution's published Mediation Rules. These rules provide a clear and structured framework for initiating mediation, appointing mediators, conducting confidential discussions, and documenting settlements.
The Rules are designed to encourage constructive dialogue while preserving fairness, confidentiality, and procedural clarity. They provide flexibility for the parties and the mediator to shape the process in a way that supports meaningful resolution.
Appointment of Mediators
Mediators are appointed through the institution to ensure neutrality, professional competence, and independence. The Court may appoint a mediator upon request of the parties or confirm a jointly nominated mediator where appropriate.
Each mediator must disclose any circumstances that could affect their impartiality before accepting the appointment. This process ensures that mediation is conducted by a trusted and independent professional capable of facilitating balanced negotiations.
Settlement Framework
Mediation is a voluntary process aimed at helping parties reach a mutually acceptable resolution. The mediator does not impose a decision but facilitates structured discussions that allow parties to explore practical solutions and common ground.
Where a settlement is reached, the terms are documented in a written settlement agreement between the parties. This agreement reflects the outcome of the mediation and may be structured to provide legal certainty and enforceability where required.
